These Terms of Service (“Terms”) govern your access to and use of the any game(s) published by Odacova Games, the Odacova Games website(s), including any individual game websites, and related services operated by Odacova Games LLC (“Odacova Games,” “we,” “us,” or “our”) (collectively, the “Services”).
By accessing or using the Services, you agree to these Terms. If you do not agree, do not use the Services.
You must be legally capable of entering into these Terms to use the Services. If you are under the age of majority in your jurisdiction, you may use the Services only with the involvement of a parent or legal guardian, where permitted by law.
Some features may require an account. You agree to provide accurate information, maintain the confidentiality of your credentials, and promptly notify us of unauthorized use of your account.
You are responsible for activity occurring under your account to the extent permitted by law.
We may suspend, restrict, or terminate accounts that violate these Terms or create legal, operational, security, or gameplay integrity risk.
Subject to your compliance with these Terms, Odacova Games grants you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to access and use the Services for personal, non-commercial entertainment purposes.
Except as expressly permitted by law, you may not copy, modify, distribute, sell, lease, reverse engineer, decompile, create derivative works from, or otherwise exploit any part of the Services.
You agree not to:
• Cheat, exploit bugs, manipulate ratings or rankings, or interfere with fair competition
• Use bots, scripts, automation, hacks, mods, packet manipulation, or unauthorized third-party tools
• Attempt unauthorized access to accounts, systems, servers, APIs, or data
• Harass, threaten, abuse, impersonate, or otherwise harm other players or our staff
• Use offensive, infringing, unlawful, or deceptive usernames, profile content, or other user-facing content
• Interfere with the integrity, security, or operation of the Services
• Use the Services in violation of applicable law or regulation
To help preserve fair play and service integrity, we may monitor gameplay activity, investigate suspicious conduct, review exploit or abuse reports, and take enforcement action where appropriate.
To the extent permitted by law, we may issue warnings, remove content, restrict features, reset rankings or ratings, void results, suspend accounts, or terminate access. We are not required to disclose our anti-cheat, fraud-detection, moderation, or enforcement methods.
We may add, remove, modify, suspend, or discontinue any feature, game mode, event, progression system, leaderboard, account feature, or other aspect of the Services at any time, with or without notice, subject to applicable law.
We do not guarantee uninterrupted availability, error-free operation, or compatibility with all devices or regions.
If the Services include purchases, subscriptions, premium features, virtual items, or virtual currency, those digital items are licensed, not sold, except where otherwise required by law.
They have no cash value, are non-transferable unless expressly permitted, and may be modified, suspended, or discontinued.
All purchases are final except where refunds are required by law or made available through the applicable platform.
If you submit or make available usernames, profile names, support submissions, feedback, communications, or other content through the Services (“User Content”), you grant Odacova Games a non-exclusive, worldwide, royalty-free license to host, store, reproduce, modify, display, distribute, and otherwise use that content as reasonably necessary to operate, improve, promote, moderate, and provide the Services.
You represent that you have the necessary rights to your User Content and that it does not violate law or third-party rights.
If you provide suggestions, ideas, or feedback about the Services, you grant Odacova Games the right to use that feedback without restriction or compensation.
The Services and all related content, including software, code, text, graphics, artwork, logos, branding, audiovisual content, interface designs, badges, gameplay presentation, and related materials, are owned by or licensed to Odacova Games and are protected by intellectual property and other laws.
Except for the limited license expressly granted in these Terms, no rights are granted to you.
The Services may be made available through third-party platforms or rely on third-party services, including app stores, hosting providers, payment processors, analytics providers, advertising providers, or cloud infrastructure. Your use of those third-party services may also be subject to their own terms and policies.
You may stop using the Services at any time. We may suspend or terminate your access to all or part of the Services if we reasonably believe you have violated these Terms or engaged in conduct that creates legal, security, abuse, or service integrity risk.
Upon termination, the license granted to you ends immediately.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICES ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS. ODACOVA GAMES DISCLAIMS ALL WARRANTIES, EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.
We do not guarantee that the Services will be uninterrupted, secure, or error-free, or that defects will be corrected.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, ODACOVA GAMES AND ITS AFFILIATES, OFFICERS, EMPLOYEES, CONTRACTORS, LICENSORS, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR BUSINESS OPPORTUNITY, ARISING OUT OF OR RELATED TO THE SERVICES OR THESE TERMS.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SERVICES OR THESE TERMS WILL NOT EXCEED THE GREATER OF: (A) THE AMOUNT YOU PAID TO US, IF ANY, FOR THE RELEVANT SERVICE IN THE TWELVE MONTHS BEFORE THE CLAIM; OR (B) USD $100.
Some jurisdictions do not allow certain limitations, so parts of the above may not apply to you.
To the extent permitted by law, you agree to indemnify and hold harmless Odacova Games and its affiliates, officers, employees, contractors, licensors, and service providers from claims, liabilities, losses, damages, and expenses arising out of your violation of these Terms, your misuse of the Services, or your infringement of any rights of another.
These Terms are governed by the laws of the State of Colorado, without regard to conflict of law rules, except where otherwise required by law.
Any dispute arising out of or relating to these Terms or the Services shall be brought in the state or federal courts located in Colorado, and you consent to the personal jurisdiction and venue of those courts, unless otherwise required by applicable law.
If you download or access TileTarget or any Odacova Games app through the Apple App Store, Google Play, or another third-party platform, you acknowledge that these Terms are between you and Odacova Games, not the platform provider, except as required by applicable platform terms or law.
To the extent applicable, the platform provider is not responsible for maintenance, support, or claims relating to the Services.
We may update these Terms from time to time. If we make material changes, we may provide notice through the Services or by other reasonable means. Your continued use of the Services after updated Terms take effect means you accept the revised Terms.
